Terms of Service

1. Acceptance of Terms

By accessing or using TeleThinker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including account holders, employees, and callers interacting with AI agents powered by TeleThinker.

2. Description of Service

TeleThinker provides AI-powered phone answering agents for businesses. The Service includes AI voice agents that answer phone calls, a dashboard for managing scripts and settings, phone number provisioning, call analytics, and integration with third-party tools.

3. Account Responsibilities

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must be at least 18 years old to create an account
• You must not share your account with unauthorized parties

4. Acceptable Use

You agree not to use TeleThinker to:

• Violate any applicable laws or regulations
• Make fraudulent or deceptive calls
• Impersonate individuals or organizations
• Conduct robocalling, spam, or telemarketing without proper consent
• Collect personal information without proper disclosure
• Process sensitive personal data (health, financial, etc.) without proper safeguards
• Engage in any activity that could harm the Service or other users

5. AI Agent Conduct

Your AI agent acts on your behalf. You are responsible for ensuring that your agent's scripts, greetings, and behaviors comply with all applicable laws, including telemarketing regulations, recording consent laws, and consumer protection statutes. TeleThinker provides tools to help with compliance (recording disclosures, AI identity statements) but ultimate responsibility rests with you as the account holder.

6. Call Recording

Call recording is an optional feature that is disabled by default. If you enable call recording, you are responsible for ensuring compliance with all applicable recording consent laws in your jurisdiction. TeleThinker's AI agents will provide a recording disclosure at the start of each recorded call, but you should verify this meets your legal requirements.

7. Billing & Subscriptions

• Subscription plans are billed monthly through our secure payment processor
• Usage is measured in minutes and phone numbers, as described on our pricing page
• You may cancel your subscription at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis; contact support for refund requests
• We reserve the right to change pricing with 30 days' notice

8. Data Ownership

You own all data generated through your use of the Service, including call transcripts, summaries, leads, and recordings. We process this data on your behalf to provide the Service. You may export or delete your data at any time through your account dashboard or by contacting us.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party service providers whose availability is outside our direct control. We are not liable for losses resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, TeleThinker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these terms, fail to pay for the Service, or engage in activity that harms other users or the platform. Upon termination, your data will be retained for 30 days to allow for export, after which it will be permanently deleted.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law provisions.

15. SMS Messaging Terms

By opting in to SMS from TeleThinker, you agree to receive transactional and customer-care text messages related to your account activity and service interactions. Message frequency may vary.

• Message and data rates may apply based on your wireless plan
• Reply STOP to opt out
• Reply HELP for help
• Consent to SMS is not a condition of purchase
• Carriers are not liable for delayed or undelivered messages

16. Third-Party Integrations & Authorization

TeleThinker integrates with third-party services including calendar providers (Google Calendar, Microsoft Outlook), payment processors, and workflow automation tools. When you connect a third-party service:

• You authorize TeleThinker to access and use data from that service on your behalf, as described in our Privacy Policy.
• You are responsible for maintaining valid authorization. If your authorization expires or is revoked, related features (such as real-time availability checking or automatic event creation) will be unavailable until you reconnect.
• TeleThinker's use of third-party service data is governed by both this agreement and the applicable provider's API policies (e.g., Google API Services User Data Policy).
• You may disconnect any third-party integration at any time from your Integrations page.
